Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client", "you", "your") and Four Capital Ltd ("Company", "we", "us", "our"), governing your access to and use of the HostingBox platform and all related services. By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms. If you do not have such authority, or if you do not agree with these Terms, you must not accept these Terms and may not use our services.

2. Description of Services

Four Capital Ltd operates a managed web hosting platform that provides the following services ("Services"):

  • Domain Management: Self-service domain provisioning with automated DNS zone creation, whitelabel nameserver configuration, and centralised domain portfolio management.
  • DNS Hosting: Globally distributed DNS hosting with anycast nameservers, automatic record management, and low-latency resolution.
  • SSL/TLS Certificate Management: Automated provisioning, installation, and renewal of SSL/TLS certificates for all domains managed through the platform.
  • Web Hosting Infrastructure: Managed hosting infrastructure including load balancing, reverse proxy services, and content delivery across multiple server locations.
  • Email Forwarding: Professional email forwarding services, allowing clients to receive email at custom domain addresses and forward to existing inboxes.
  • Security Services: Security header enforcement, TLS protocol management, HSTS configuration, and DDoS mitigation on all hosted domains.

We reserve the right to modify, enhance, or discontinue any part of the Services at any time. We will provide at least 30 days' notice for any material changes that may adversely affect your use of the Services.

3. Account Registration and Approval

To access our Services, you must register for an account by providing accurate, current, and complete information. All new accounts are subject to review and approval by Four Capital Ltd. We reserve the right to approve or decline any account registration at our sole discretion and without obligation to provide a reason.

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorised use of your account.
  • Ensuring that your account information remains accurate and up to date.

You may not transfer your account to another party without our prior written consent. We may suspend or terminate accounts that have been inactive for an extended period, with reasonable notice.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You must not use our Services to:

  • Host, distribute, or link to any content that is unlawful, defamatory, obscene, fraudulent, or that infringes upon the intellectual property rights of others.
  • Distribute malware, viruses, or any other harmful software or code.
  • Conduct phishing, spam, or any form of unsolicited communication.
  • Engage in activities that disrupt, interfere with, or place an unreasonable burden on our infrastructure or the experience of other clients.
  • Attempt to gain unauthorised access to any systems, networks, or data not intended for your use.
  • Violate any applicable local, national, or international law or regulation.

We reserve the right to investigate potential violations of this policy and to take appropriate action, including suspension or termination of your account, removal of content, and reporting to law enforcement authorities where required.

5. Payment Terms

Fees for our Services are as specified on our website or as agreed upon at the time of purchase. Unless otherwise stated:

  • All fees are quoted and payable in US Dollars (USD).
  • Payments are due in advance for each billing period (monthly or annually, as selected).
  • Fees are non-refundable except where required by applicable law or as otherwise specified in writing.
  • We reserve the right to adjust pricing with at least 30 days' written notice before the start of your next billing period.
  • Failure to pay fees when due may result in suspension of Services. Services will be restored upon receipt of payment.

All applicable taxes, duties, and levies imposed by taxing authorities are your responsibility unless explicitly stated otherwise.

6. Service Availability and Support

We are committed to providing reliable Services and strive to maintain high levels of availability. While we target 99.99% uptime for our hosting infrastructure, we do not guarantee uninterrupted or error-free operation of the Services.

Technical support is available via email and through the client dashboard. Response times and support scope vary by plan:

  • Starter Plan: Email support during business hours.
  • Pro Plan: Priority email support with faster response times.
  • Elite Plan: 24/7 priority support with dedicated assistance.

Scheduled maintenance windows will be communicated in advance where possible. We shall not be liable for any downtime caused by factors outside our reasonable control, including but not limited to force majeure events, upstream provider outages, or distributed denial-of-service attacks.

7. Domain and DNS Configuration

When you add a domain to our platform, we automatically provision DNS zones, nameservers, and associated records on your behalf. You are responsible for:

  • Ensuring you have the legal right to use and configure the domain names you add to the platform.
  • Updating your domain registrar to point to the nameservers provided by our platform.
  • Maintaining valid domain registrations with your registrar.

We are not responsible for issues arising from expired domain registrations, registrar-level misconfigurations, or domains you do not have authorisation to use.

8. Intellectual Property

All intellectual property rights in the HostingBox platform, including its design, software, documentation, and branding, are and remain the property of Four Capital Ltd. Nothing in these Terms grants you any rights to our intellectual property except as expressly stated.

You retain all ownership rights in the content you host through our Services. By using our Services, you grant us a limited, non-exclusive licence to store, process, cache, and transmit your content solely as necessary to provide the Services.

9. Data Handling and Backups

While we take reasonable precautions to protect the integrity of data stored on our systems, you acknowledge that it is your responsibility to maintain independent backups of your content and configurations. We shall not be liable for any loss of data, regardless of cause.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Four Capital Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising from your use of or inability to use our Services.
  • Our total aggregate liability for any claims arising under or in connection with these Terms shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim.
  • The Services are provided on an "as is" and "as available" basis. We make no warranties or representations, express or implied, regarding the Services, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless Four Capital Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your content, or your violation of these Terms.

12. Termination

Either party may terminate the service agreement at any time by providing written notice. Upon termination:

  • We will cease providing the Services and your access to the platform will be revoked.
  • You will have a reasonable period (not less than 14 days from the date of termination notice) to export your data and update your domain configurations.
  • After the data retrieval period, we may permanently delete all content and configurations associated with your account.
  • Any outstanding fees for Services rendered prior to termination remain payable.

We may immediately suspend or terminate your account without notice if we reasonably believe you have violated the Acceptable Use Policy, engaged in fraudulent activity, or if required to do so by law.

13. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Four Capital Ltd is incorporated, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will notify you of material changes by email or through a prominent notice on our platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
